UPDATE 1/13/07 - I received notice from 1&1 stating that they have indeed canceled my account in accordance to the 90 day-money back guarantee! Hurray!
I'm constantly searching for a different web host for my ASP.NET stuff, and in my investigating, I recently made the mistake of signing up with 1&1 Internet (or 1and1 internet)..
The post that follows is rather lengthy, and outlines my entire correspondence with 1&1 Internet thus far. The readers digest version is this:
I signed up, assuming there was a 90-day money back guarantee, which is plastered all over their site. I read the Terms & Conditions, and NOWHERE did it mention that it was not applicable. In fact, it was quite the opposite, it explicitly says that it IS applicable. Anyway, I was informed RUDELY by 1&1's "customer service" that I would not be getting my money back, due to some hidden Terms & Conditions.... We went back and forth on emails, and I called and yelled. All to no avail at this point.
The moral of the story is:
1&1 Internet is deceptive and fraudulent. DO NOT SIGN UP. You will be cheated.
Alas, hindsight is 20/20, and only now do I know that I'm not the only one who has fallen victim to 1and1's fraud...
What a shame.
My encounter with them and all of our correspondence back and forth is below....

I initially signed up because the were able to offer unlimited domains with their Windows hosting package, which is something GoDaddy (my current host) never was able to do. So, I figured I'd try them out, given that they have a "90 day money-back guarantee - no questions asked"... riiiiiight, no questions asked my ass.
Literally hours after signing up, I discovered that GoDaddy DOES offer unlimited domains! (They never used to) With that, I had no use for my 1and1 account, so I decided to cancel it. I HADN'T UPLOADED FILES OR ANYTHING. NOTHING.
Blah blah blah, I cancel my account with 1&1's online cancel utility, blah blah. Time passes, and I send an email to verify that I wont be charged:
Just to confirm, I have not been charged for this purchase correct? I cannot tell if my credit card was charged for the purchase yet or not. I just signed up a few days ago.
To which I recieve this response from Neil Lacerna of 1&1:
With regards to the package that you've purchased, we have a 90 day
money back guarantee. It means that you will received your money back,
and that will debited directly to your card.
Hurray! (I thought) No problems!
Boy was I WRONG.
A few days later, lo and behold, there's a charge on my credit card from 1 & 1 Internet services for $30. "Oh, they must be going to reverse that charge", I think to myself. So, I fire off a friendly email...
On 1/02/2007 my credit card was charged for this invoice, even though I have canceled my account according to the "90 days money back guarantee". In fact, I only had my account for less than a week. Please reverse the charge to my credit card. Thank you.
Here's where it gets interesting.... I get this response from some guy named Jim Reitnour:
There is one thing you are overlooking. You signed up for a promotional

WTF!!!!! ARE YOU KIDDING ME??!?!?! This was mentioned NOWHERE on ANY of the pages on or around the signup page!
(I'm furious just typing this post... *sigh*... calm down dusty)
I actually had read through the Terms and Conditions, both on the page I signed up on, and on the 90-day money back guarantee site... All of those T&C's contradict the email I recieved...
From the 1and1 Money Back Guarantee Terms and Conditions page..
The 1&1 Money Back Guarantee applies to Instant Mail, Instant Website, Linux and Microsoft Shared Hosting, Microsoft SharePoint or Exchange Hosting and eShops.
From the CHECKOUT PAGE:
A full refund (minus software shipping and handling fees and bandwidth) will be given through the 1&1 Money Back Guarantee for all our web hosting packages if you cancel your account within 90 days.
The only place you can find this so called "50% Off Terms and Conditions" is buried DEEP within the site. Click on the T&C Link at the bottom of the page, then hidden in the left navigation you are supposed to see those terms and conditions.
I send a handfull more emails, my anger escalating with each one that goes unanswered.
I finally decide to give the billing department a call... I start off polite, but I can only be given the run-around for SO LONG before I get REALLY ANGRY. 30 minutes of my anger rising later, I find out that my only course of action is to send and email to the allusive (and probably black hole) complaints@1and1.com (who, by the way, aparently have no PHONE, as I was not able to be transfered there... surprise, surprise).
So, I send them one final email...
Dear Complaints department,
I have been trying to cancel my account per the "90 day money back guarantee", and have been given the complete run around, which I'm sure you're aware of.
EVERYWHERE on your site mentions the 90 day money back, INCLUDING on in ALL VERBIAGE on and surrounding the signup page.
I'm not telling you anything you don't already know, though. Not only was the person below rude, the "billing supervisor", Ian, I spoke with refused to be helpful at all. I'm sure that's policy. He told me to contact you here as my "only resort".
I simply would like my account canceled. I signed up, did not even USE it (no files uploaded, no domains, no bandwidth). I canceled less than 24 hours after signing up, assuming I could get my money back "no questions asked".
Please respond.
Alas, all I can do now is wait. Tomorrow, if I don't hear back, I'm REALLY going to be pissed, and I will call them again and yell some more. And I will continue to do so daily until all is right, or until my contract is up - whichever comes first.
